Drug Trafficking Penalties in Illinois
A person can be convicted of drug trafficking if it can be proven that they brought marijuana or a controlled substance (such as cocaine, heroin or LSD) into Illinois with the intent to manufacture or deliver either within the state or elsewhere. Trafficking small amounts of marijuana (up to 10 grams) is a Class B or Class A Misdemeanor, with fines ranging from $1,500 to $2,500 and six months to a year in county jail. Trafficking over 10 grams of marijuana becomes a Felony with longer prison terms and fines starting at $25,000. Trafficking of a controlled substance in Illinois can be anywhere between a Class 3 and Class X Felony depending on the type of substance and the amount brought into the state. A conviction can result in a minimum of four years in prison and fines starting at $75,000.
